The Real RCS Deal Revealed
The continued hypocrisy of the RCS scam continues to grow despite Rongberg’s protestations against accusations of the unethical nature of this scam. As you all recall, he and his bulldog attorney threatened to sue Dr. Stephen Perle, publisher Don Petersen and me for exposing this tacky research project. In his outrageous articles condemning the three of us, TR had us all convicted of defamation despite the obvious truth that this RCS is a scam. Rather than addressing our complaints, TR used his customary tactic to ridicule his critics without regard for the facts—bluster without reason characterizes his argument—and he wonders why he’s characterized as a yellow journalist.
Now you can read for yourself from the horse’s mouth the recruitment letter and financial deal involved in the RCS scam. Again, ask yourself what legitimate research project charges nearly $8,000 to participate (this down from the original $14,000 fee) and now includes free junk from other evil vendors? Okay, stop laughing!

Okay, stop gasping! Have you ever seen any supposed research marketed in this fashion? Of course not, at least not outside of the WCA chiropracTIC faction, that is. If this isn’t enough evidence to all, especially to the state board of examiners who are supposed to protect the public from scams, what more will it take to prove this RCS is a vendor-driven exploitation of this profession and the public?
Now TR and Jackson resort to tempting prospective clients with their latest scheme of offering $8,000 of products or services from “top coaches and leaders in the chiropractic profession.” Okay, stop ckoking because we all know this is patently untrue—only evil vendors would stoop to this level. Obviously this RCS scam isn’t selling well in the profession or else they wouldn’t have to resort to this give-away gimmick.
What’s next: Free chicken dinners, ya folla?
So, for those interested in the RCS scam, here’s the salespitch and the deal verbatim.
Judge for yourself if this is a credible venture that will lead to proving the Big Idea as they contend. Read about becoming an official “RCS Authorized Clinical Investigator”, using the “RCS Vitality Wellness Index Report” for each volunteer whose data is uploaded to the RCS Research Database, a “Fellowship in Health Outcomes Research” certificate, and that “RCS has permission to use the doctor’s name, credentials and image on RCS material, including, but not limited to, educational and promotional material, in RCS’ sole discretion, without limitation, and without compensation.” (Such a deal, ya folla?)

In an impressive display of unity, more than a dozen of the top “coaches” and leaders in the chiropractic profession have united behind a single research effort: Research & Clinical Science (RCS). These leaders, showing magnificent support for the global research program, are offering products or services ‑‑ such as seminars, books, audio programs, consultations, DVD presentations, etc.
The donated products and/or services will be compiled into the RCS “Top Coaches and Leaders Practice Success Kit” and given, free, to doctors who join the RCS Program. Dr. Jackson said one of the main effects of the Kit will be to show the world that the chiropractic profession is united in its determination to conduct a valid, scientific investigation of the impact of vertebral subluxation on health. “Right now, so much of our research is aimed at proving that chiropractic can relieve back pain,” he explained. “We need more than that if we’re going to break out of the tiny box. We need to make a bold statement that we are ready to put chiropractic to the test.”
To begin accumulating the required data, RCS wants to have hundreds of DCs recruiting volunteers who will fill out detailed demographic and self‑reported quality of life questionnaires, and receive free chiropractic examinations.
Identical data will be taken from individuals who have never had chiropractic care as well as from those who have received adjustments, either before or after their enrollment as research subjects. The “after” data will be collected from the RCS doctor’s existing patients willing to participate in the project, as well as from research volunteers who subsequently request patient care.
“When we start producing and publishing the results of this study, every one of these chiropractic leaders will be able to take part of the credit,” stated Jackson. “They’ll know they were the ones who stepped forward to do what the profession has needed to do for more than a century.”

Initial enrollment fee is due upon application. Research & Clinical Science Agreement
Research & Clinical Science (RCS) will:
· Involve the doctor in significant scientific chiropractic research, by having the doctor participate population-based, longitudinal cohort outcome studies approved by an independent Institutional Review Board (IRB).
· Make available to the doctor all the protocols, procedures and reporting designs needed to act as an RCS Authorized Clinical Investigator. This includes proprietary, web-based computer technology, training and support material such as forms and agreements, volunteer recruitment materials, office displays, start-up brochures and other necessary material.
· Provide an “RCS Vitality Wellness Index Report” for each volunteer whose data is uploaded to the RCS Research Database.
· Issue, upon successful completion of RCS training, a “Fellowship in Health Outcomes Research” certificate and assist in the application and approval process for the doctor by an independent IRB.
· Designate the doctor’s office as an RCS Authorized Practice-Based Research Site. This agreement covers only the office location listed under the doctor’s signature. If the doctor maintains more than one office location, a separate agreement will be required for each additional location to be involved in the program.
· Provide advice and assistance so the doctor can submit case studies to scientific, evidence-based, peer- reviewed research journals for publication consideration. RCS does not guarantee publication of any papers.
· Comply with all applicable federal, state, and local laws, codes, rules, regulations and ordinances, and executive orders, including the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). It will also remove volunteer, patient and doctor identifying data to ensure confidentiality.
Applicants are responsible for:
· Returning IRB documents and paperwork to RCS in a timely manner. Delays in IRB processing will not affect billing cycle.
· Complying with all applicable federal, state, and local laws, codes, rules, regulations and ordinances, and executive orders; ethical obligations; and rules, regulations and protocols of the RCS Program. It is the doctor’s responsibility to ensure compliance with state laws and board regulations.
· Using RCS materials to recruit or process volunteers, educate patients or the public about RCS, or disseminate any information about RCS. No material can be used in conjunction with the RCS program that was not developed by RCS or approved, in writing, by RCS.
· Not disclosing any confidential information about or provided by RCS. “Confidential Information” includes (but is not limited to) patents, copyrights, proprietary information, trade secrets, systems procedures, manuals, confidential reports, processes, know-how, forms, formulas, specifications, computer programs, computer software, databases, designs, copies, layouts, other original works of authorship, and statistical methods of compiling information.
Other Terms:
· This agreement begins when signed and will continue for a minimum of three years. Upon completion of the initial three-year period, the doctor may discontinue his/her status as an RCS Clinical Investigator by notifying RCS in writing. Due to the nature of the copyrighted material and proprietary information provided, there shall be no refunds.
· All volunteer and patient data provided by the doctor to RCS will be the sole and exclusive property of RCS.
· RCS has permission to use the doctor’s name, credentials and image on RCS material, including, but not limited to, educational and promotional material, in RCS’ sole discretion, without limitation, and without compensation.
· If a doctor fails to adhere to all RCS provisions and regulations, or if he/she conducts RCS research in any manner deemed unethical or unprofessional by RCS, RCS has the right to terminate this agreement. If RCS terminates an agreement, no refunds for already paid fees will be made. If a doctor fails to pay the monthly fee as provided in this agreement, the unpaid account may be turned over to a collection agency or an attorney.
· Upon expiration of this agreement, the doctor will no longer be affiliated with the RCS Program, and will be prohibited from recruiting volunteers or conducting any other procedures on behalf of RCS. If a doctor continues using any RCS materials and/or procedures or continues to represent himself or herself as an RCS-affiliated clinical investigator, RCS will report that doctor to all appropriate state boards and other governing authorities.
· By signing this agreement, the doctor represents to RCS that he/she is in compliance with any and all applicable laws and has acquired and will comply with any and all material licenses and approvals required under rules and regulations of any and all governmental entities or agencies applicable to the Doctor.
· Except as expressly provided in this agreement, RCS makes no warranties as to the services, study, products, materials, equipment or information provided. No warrantees and/or guarantees are given or implied.
· RCS assumes no liability for special, incidental, indirect, punitive or consequential damages (including, without limitation, loss of opportunity, lost profits, lost revenue, loss of use or claims of third parties) arising out of or in any manner in connection with the performance, breach or subject matter of this agreement, however caused, whether by negligence or otherwise, regardless of the form of action, in tort, contract or other legal theory, whether or not RCS has been advised of or otherwise might have anticipated the possibility of such damages.
· This Agreement shall be governed by and construed in accordance with the laws of the State of California without reference to its choice of law principles and as if wholly performed within the State of California. Any litigation regarding the interpretation, breach or enforcement of this Agreement shall be filed in and heard by the state or federal courts having jurisdiction to hear such disputes in San Diego County, California, and the parties hereby expressly submit to the jurisdiction of such courts.
